Seclusion and Restraint Procedures
(1)
Certified facilities shall not use seclusion and restraint except in an emergency and only then subject to the conditions and limitations of these rules.(2)
General procedures.(a)
Only a physician, nurse practitioner, physician assistant or nurse may initiate seclusion or restraint procedures.(b)
Each use of seclusion or restraint shall be monitored and supervised by a physician or a nurse.(c)
A physician responsible for the patient’s care must order the use of seclusion or restraint within one hour of the administration of the procedure. This approval must be documented in the person’s medical record. The physician’s order may occur by the following methods:(A)
Verbally, in person or via telephone;(B)
By Computerized Medical Record; or(C)
By a written order.(d)
Within one hour after the initiation of the seclusion or restraint intervention, the patient must be seen face-to-face by a physician, a registered nurse or physician assistant who has been trained in accordance with these rules.(e)
If the face-to-face evaluation is performed by a registered nurse or physician assistant, the evaluator must consult with the attending physician as soon as possible following the face-to-face evaluation.(f)
The face-to-face evaluation must include the following:(A)
An evaluation of the patient’s immediate situation;(B)
The patient’s reaction to the intervention;(C)
The patient’s medical and behavioral condition; and(D)
The need to continue or terminate the restraint or seclusion
