Payment Procedures

If a measure or measures recommended in the applicable TAS but not previously eligible for payment due to environmental restrictions become eligible for payment, the Department may:

(1)

Pay retroactively for such measure or measures in accordance with the amounts established in OAR 330-068-0090 (Payment Levels), if such measure or measures were installed prior to the change in environmental restrictions; or

(2)

Pay retroactively for the installation of such measure or measures in accordance with amounts established in OAR 330-068-0090 (Payment Levels) if such measure or measures are subsequently installed.
