For purposes of this division, except when a different scope is explicitly stated:

“Consumer-owned utility” has the meaning given to the term under ORS 757.270 (Definitions for ORS 757.270 to 757.290)(2).

“Energy utility” means a public utility as defined in ORS 757.005 (Definition of public utility) except a water utility or wastewater utility. An energy utility can be an “electric company,” “gas utility,” or “steam heat utility.”

“Large telecommunications utility” means any telecommunications utility, as defined in ORS 759.005 (Definitions) that is not partially exempt from regulation under 759.040 (Exemptions for certain unaffiliated utilities with fewer than 50,000 access lines).

“Non-energy attributes” means the environmental, economic, and social benefits of generation from renewable energy facilities. These attributes are normally transacted in the form of Tradable Renewable Certificates.

“Utility” means all energy utilities and large telecommunications utilities, as defined in sections (2) and (3) of this rule.
