Willamette River Cleanup Authority

(1)

There is established a Willamette River Cleanup Authority consisting of five members. The authority shall be composed of:

(a)

The Governor;

(b)

Two members of the House of Representatives, appointed by the Speaker of the House of Representatives; and

(c)

Two members of the Senate, appointed by the President of the Senate.

(2)

The purpose of the authority is to:

(a)

Receive periodic reports from the Department of Environmental Quality, the United States Environmental Protection Agency and potentially responsible parties involved in the remedial investigation and feasibility study process relating to the listing of the Willamette River on the National Priorities List described in 42 U.S.C. 9605; and

(b)

Make recommendations to the Legislative Assembly on the amount of general obligation bonds or other bonds that would need to be issued to pay for the implementation of all or a portion of the record of decision of the remedial investigation and feasibility study process.

(3)

The Governor shall serve as chairperson, and a majority of members constitutes a quorum for the transaction of business.

(4)

All agencies of the state government, as defined in ORS 174.111 (“State government” defined), are directed to assist the authority in the performance of its duties and, to the extent permitted by laws relating to confidentiality, to furnish such information and advice as the members of the authority consider necessary to perform their duties.

(5)

The authority may hold public meetings for the transaction of any of its business at the times and places as it may prescribe. At any such public hearing, any person interested in the matter being investigated may appear and testify.

(6)

The authority shall establish such advisory or technical committees as it considers necessary to aid and advise the authority in the performance of its duties. The authority shall determine the representation, membership, terms and organization of the committees and shall appoint committee members, except that at least one advisory committee shall be composed of representatives of property owners in the area that is the subject of the remedial investigation and feasibility study, state and local environmental organizations, the Port of Portland, the City of Portland and private-sector labor representatives.

Members of the advisory or technical committees are not entitled to compensation nor reimbursement for actual and necessary travel and other expenses. [2003 c.696 §3]
