“Nongame wildlife” defined

As used in ORS 496.380 (Designation of tax refunds to finance program) to 496.390 (Control over fund by department) “nongame wildlife” means all wildlife species over which the State Fish and Wildlife Commission has jurisdiction, except game mammals, as defined in ORS 496.004 (Definitions), fur-bearing mammals as defined in ORS 496.004 (Definitions), game birds as defined in ORS 496.007 (“Game bird” defined) and game fish as defined in ORS 496.009 (“Game fish” defined). Fish and Wildlife Commission has statutory authority to provide by rule for is suance of special ceremonial hunting permits for specific tribes that are not otherwise allowed under hunting and fishing agreement between federal and state governments and that tribe.
