General Requirements for Medical Marijuana Processing Sites and Dispensaries: Inspections
(1)
The Authority must conduct a routine inspection of every registrant at least every year.(2)
The Authority may conduct a complaint inspection at any time following the receipt of a complaint that alleges a registrant or registrant representative is in violation of ORS 475B.840 (Marijuana processing site registration system), ORS 475B.840 (Marijuana processing site registration system) to 475B.852 (Prohibition against transferring medical cannabinoid products, concentrates and extracts to certain persons), 475B.858 (Medical marijuana dispensary registration system) to 475B.867 (Duty to submit dispensing data to Oregon Health Authority), 475B.555 (Testing standards and processes), 475B.605 (Labeling requirements), 475B.615 (Packaging requirements), OAR chapter 333, division 7 or these rules.(3)
The Authority may conduct an inspection at any time if it believes, for any reason, that a registrant or registrant representative is in violation of ORS 475B.840 (Marijuana processing site registration system) to 475B.852 (Prohibition against transferring medical cannabinoid products, concentrates and extracts to certain persons), 475B.858 (Medical marijuana dispensary registration system) to 475B.867 (Duty to submit dispensing data to Oregon Health Authority), 475B.555 (Testing standards and processes), 475B.605 (Labeling requirements), 475B.615 (Packaging requirements), OAR chapter 333, division 7 or these rules.(4)
The Authority may inspect the following to ensure compliance with ORS 475B.840 (Marijuana processing site registration system) to 475B.852 (Prohibition against transferring medical cannabinoid products, concentrates and extracts to certain persons), 475B.858 (Medical marijuana dispensary registration system) to 475B.867 (Duty to submit dispensing data to Oregon Health Authority), 475B.555 (Testing standards and processes), 475B.605 (Labeling requirements), 475B.615 (Packaging requirements), OAR chapter 333, division 7 or these rules:(a)
The premises of a proposed marijuana processing site or dispensary, or registered marijuana processing site or dispensary; and(b)
The records of a registered marijuana processing site or dispensary.(5)
Registrant representatives must cooperate with the Authority during an inspection.(6)
If an individual at a registered dispensary or processing site fails to permit the Authority to conduct an inspection or if the Authority requires access to a dispensary or processing site and cannot obtain permission the Authority may seek an administrative warrant authorizing the inspection pursuant to ORS 431A.010 (Power of Oregon Health Authority and local public health administrators to enforce public health laws).(7)
The Authority may purchase, possess or seize a marijuana item as necessary for the Authority to determine compliance with ORS 475B.840 (Marijuana processing site registration system) to 475B.852 (Prohibition against transferring medical cannabinoid products, concentrates and extracts to certain persons), 475B.858 (Medical marijuana dispensary registration system) to 475B.867 (Duty to submit dispensing data to Oregon Health Authority), 475B.555 (Testing standards and processes), 475B.605 (Labeling requirements), 475B.615 (Packaging requirements), OAR chapter 333, division 7 or these rules.
