Bidder Examination


Bidders, before submitting a bid, shall make a careful examination of the contract documents and the site of the sale and any appended project work. Such examination shall be independent of any representations by the STATE concerning the quality and quantity of timber, the allowable method of removal of the timber or of conditions affecting the work at the site. Pursuant to OAR 629-029-0135 (Contract Requirements), every contract shall contain a clause requiring such an examination and absolving the STATE from any liability for any misrepresentation or failure to provide information. Bidders shall have independently:

(1)

Fully informed themselves as to the quality and quantity of materials and the character of the operations required; and

(2)

Have made a careful examination of the location and quantity and quality of the forest products to be sold.
