Post-Decision Review Processes

(1)

Types of Post-Decision Review Processes. Three types of post-decision review processes are available to an applicant under division 51:

(a)

Post-decision collaborative discussion (OAR 734-051-3090 (Post-Decision Collaborative Discussion));

(b)

Dispute review board (OAR 734-051-3100 (Access Management Dispute Review Board)); and

(c)

Contested case hearing (OAR 734-051-3110 (Contested Case Hearing Process)).

Sequence of Reviews.

(a)

Except as noted in subsection (b) of this section, an applicant may request any or all of the types of reviews listed in section (1) of this rule, provided the reviews must be conducted in sequence (a) through (c).

(b)

An applicant seeking further review of a determination of whether an application is moving in the direction of conformity pursuant to OAR 734-051-3020 (Change of Use of a Private Connection)(10)(a) may request a collaborative discussion or review by the dispute review board, but may not request a contested case hearing. The option of a collaborative discussion is eliminated if the applicant chooses a review by the dispute review board prior to a collaborative discussion.

Notice of Opportunity for Post Decision Reviews. Except for review of a department determination pursuant to OAR 734-051-3020 (Change of Use of a Private Connection)(10)(a), the department shall notify the applicant when processing of the application has reached an opportunity for any of the types of post-decision review and shall provide instructions about how to request a review.

Request for Post-Decision Review. Except for review of a department determination pursuant to OAR 734-051-3020 (Change of Use of a Private Connection)(10)(a), the applicant must submit a written request to the region manager within twenty-one (21) days of the mailing date of notice of an opportunity for post-decision review, identifying which type of post-decision review the applicant is choosing and the documentation to be presented to the department.

Subject of Post-Decision Reviews. Except for review of a department determination pursuant to OAR 734-051-3020 (Change of Use of a Private Connection)(10)(a), all post-decision review processes shall consider the final decision reached by the department in the processing of the application.
