Persons with operating permit exempted

The provisions of ORS 517.702 (Legislative findings) to 517.740 (Rules) do not apply if the applicant has obtained an operating permit, described in ORS 517.790 (Operating permit required for surface mining on certain lands), for the area described in the exploration permit.
