ORS 537.387
Limitations on water use related to Cannabis plants
(1)
At a location described in subsection (2) of this section, a person may not:(a)
Use, store or divert any waters under ORS 537.130 (Permit to appropriate water required);(b)
Use or attempt to use any ground water under ORS 537.535 (Unlawful use or appropriation of ground water, including well construction and operation);(c)
Construct or attempt to construct any well or other means of developing and securing ground water under ORS 537.535 (Unlawful use or appropriation of ground water, including well construction and operation);(d)
Collect or use precipitation water from an artificial impervious surface as described in ORS 537.141 (Uses of water not requiring water right application, permit or certificate); or(e)
Use ground water as described in ORS 537.545 (Exempt uses) (1)(b) or (f).(2)
A person may not engage in or undertake an action described in subsection (1) of this section at a location where plants in the plant Cannabis family Cannabaceae are grown, if:(a)
The location described in this section is not licensed or registered under ORS 475C.065 (Production license), 475C.792 (Marijuana grow site registration system) or 571.281 (Grower and handler license); and(b)
The number of plants described in this section is greater than the number of marijuana plants or industrial hemp plants allowed under ORS 475C.005 (Short title) to 475C.525 (Severability of ORS 475C.005 to 475C.525), 475C.770 (Findings) to 475C.919 (Authority to adopt rules for ORS 475C.770 to 475C.919) or 571.260 (Short title) to 571.348 (Civil penalty).
