Penalties
(1)
In addition to any penalties under subsection (2) of this section, a person who discloses confidential information in violation of ORS 469.090 (Confidentiality of information submitted under ORS 469.080), willfully or with criminal negligence, as defined by ORS 161.085 (Definitions with respect to culpability), may be subject to removal from office or immediate dismissal from public employment.(2)

Willful disclosure of confidential information in violation of ORS 469.090 (Confidentiality of information submitted under ORS 469.080) is a Class A misdemeanor. Notwithstanding ORS 161.635 (Fines for misdemeanors), the maximum fine for a violation is $10,000.(b)
Disclosure of confidential information in violation of ORS 469.090 (Confidentiality of information submitted under ORS 469.080) with criminal negligence, as defined by ORS 161.085 (Definitions with respect to culpability), is a Class A violation.(3)
