Construction of ORS 36


(1)

Except as specified in ORS 36.508 (Choice of laws), where a provision of ORS 36.450 (Definitions for ORS 36) to 36.558 (Short title) leaves the parties free to determine a certain issue, such freedom includes the right of the parties to authorize a third party, including an institution, to make that determination.

(2)

Where a provision of ORS 36.450 (Definitions for ORS 36) to 36.558 (Short title) refers to the fact that the parties have agreed or that they may agree or in any other way refers to an agreement of the parties, such agreement includes any arbitration or conciliation rules referred to in that agreement.

(3)

Except as provided in ORS 36.502 (Effect of failure to make required statement or to appear at oral hearing) (1) and 36.516 (Termination of arbitral proceedings) (2)(a), where a provision of ORS 36.450 (Definitions for ORS 36) to 36.558 (Short title) refers to a claim, it also applies to a counterclaim, and where it refers to a defense, it also applies to a defense of a counterclaim.
