Adoption of bylaws

The board of directors of Oregon Community Power may adopt bylaws necessary to administer ORS 757.812 (Definitions for ORS 757.812 to 757.950) to 757.950 (Authorization to issue and sell revenue bonds), including but not limited to:


Bylaws establishing the information the board must make available to the public prior to conducting a ratemaking hearing.


Bylaws establishing procedures for conducting a ratemaking hearing that provide for substantially the same procedures as set forth in ORS 183.415 (Notice of right to hearing), 183.425 (Depositions or subpoena of material witness), 183.440 (Subpoenas in contested cases) and 183.450 (Evidence in contested cases).


Bylaws to facilitate the implementation of the primary mission of Oregon Community Power under ORS 757.818 (Oregon Community Power created). [2007 c.807 §26]

Under regulatory scheme, Public Utility Commissioner has authority to promulgate rule limiting telephone company's liability for directory listing errors or omissions. Garrison v. Pacific NW Bell, 45 Or App 523, 608 P2d 1206 (1980)

Refund is proper exercise of Public Utility Commission's general powers if refund (1) is based only on information in existence at time of rate order for which refund is being made; (2) is not based on evaluation of public utility's actual expenses or revenues; and (3) is not effectuated by offsetting future rates.
