Exemption for redevelopment in park destroyed by natural disaster


The Director of the Department of Consumer and Business Services may waive any requirements of ORS 446.003 (Definitions for ORS 446) to 446.200 (Exemption from additional regulations) or rules adopted under those sections or adopt temporary permitting and operating and construction standards in lieu of the requirements if the director determines that:

(1)

The waiver is necessary or advisable to allow for the rapid development of a manufactured dwelling park approved under ORS 197.488 (Replacement of park destroyed by natural disaster); and

(2)

The waiver will not jeopardize the health and safety of the occupants of the manufactured dwelling park. [2021 c.260 §4]
Note: Section 5, chapter 260, Oregon Laws 2021, provides:
Sec. 5. Sections 2 [197.488 (Replacement of park destroyed by natural disaster)] and 4 [446.198 (Exemption for redevelopment in park destroyed by natural disaster)] of this 2021 Act apply to manufactured dwelling parks destroyed by natural disasters occurring on or after September 1, 2020. [2021 c.260 §5]
Note: 446.198 (Exemption for redevelopment in park destroyed by natural disaster) was added to and made a part of 446.003 (Definitions for ORS 446) to 446.200 (Exemption from additional regulations) by legislative action but was not added to any other series.
