Effect of waiver of right to jury trial


When a defendant waives the right to a jury trial on the issue of guilt or innocence, the waiver constitutes a written waiver of the right to a jury trial on all enhancement facts whether related to the offense or the defendant. [2005 c.463 §5]

Notes of Decisions

To waive constitutional right to jury trial on question of guilt or innocence, defendant must also make knowing and intentional waiver, in writing, of right to jury trial on sentencing enhancement facts. State v. Lafferty, 240 Or App 564, 247 P3d 1266 (2011)
