ORS 9.261
Resignation of attorney

(1)

An attorney may resign from membership in the bar pursuant to rules adopted by the board under ORS 9.542 (Rules for investigation of attorneys and applicants). After acceptance of the resignation by the Supreme Court, the attorney shall not be entitled to the rights nor subject to the disabilities or prohibitions incident to membership, except that the attorney is still subject to the power of the court in respect to matters arising prior to the resignation.

An attorney who has resigned may be readmitted to practice only in compliance with rules adopted pursuant to ORS 9.542 (Rules for investigation of attorneys and applicants). [1989 c.1052 §8 (enacted in lieu of 9.260)]

Where attorney was deliberately seeking to avoid receipt of mail from Oregon State Bar, failed to pay his dues and was suspended for that failure, court applied this section and held that attorney was “subject to the power of the court in respect to matters arising prior to the” suspension of attorney.
