Seizure without notice

(1)

Nothing in ORS 830.908 (Definitions for ORS 830) to 830.948 (Salvaged Vessel Subaccount) affects the ability of an enforcement agency to immediately seize without notice a vessel that presents a hazard to navigation or an imminent threat to public health or safety.

(2)

If an enforcement agency seizes without notice a vessel that presents a hazard to navigation or an imminent threat to public health or safety, and the enforcement agency wishes to dispose of the vessel under ORS 830.908 (Definitions for ORS 830) to 830.948 (Salvaged Vessel Subaccount), the enforcement agency shall provide notice as described in ORS 830.931 (Post-seizure notice).
